Are Magic Mushrooms Legal in Wyoming?

Magic mushrooms are illegal in Wyoming.

WY Stat. §§ 35-7-1014 classifies psilocybin and psilocin (the active ingredients in magic mushrooms) as a Schedule I controlled substance — meaning they have no accepted medical use and are considered unsafe with a high potential for drug abuse. While current research doesn’t support this classification, Wyoming has yet to update its laws.

If the police find you with magic mushrooms, you can receive up to 20 years in prison and fines up to $25,000.

Magic mushroom spores are an exception. You can buy magic mushroom spores online legally and have them delivered to Wyoming. However, germinating the spores for the purpose of cultivation is still illegal.

Is MDMA Legal in Wyoming?

MDMA (ecstasy) also belongs to Wyoming’s Schedule I controlled substances, so it’s illegal in Wyoming.

Therefore, you run the risk of very stiff penalties for possessing it, ranging from 20 years in prison with fines of $25,000, depending on your previous criminal record.

Soon, MDMA-assisted psychotherapy will become legal throughout the United States, including Wyoming. Unless regulators in Wyoming specifically act to ban this practice, we’re likely going to see an increase in MDMA clinics popping up around the state.

Is Ketamine Legal in Wyoming?

Possessing ketamine without a license is illegal in Wyoming.

WY Stat § 35-7-1018 places this anesthetic in the Schedule III category. This means that authorities consider it a drug with less potential for abuse, which can still lead to low physical dependence. For this reason, the penalties for possessing it are less than for the psychedelics mentioned above.

Possessing a small amount of ketamine is punishable with up to one year in prison or fined up to $1000.

Ketamine is used by doctors as a treatment for PTSD and depression. It’s also being explored as a potential treatment for addiction and substance abuse disorders — but this has yet to be approved by the FDA.

Is DMT Legal in Wyoming?

DMT (dimethyltryptamine) is also illegal throughout the country.

Possession of this drug is considered a felony offense as it’s a Schedule I controlled substance.

For possessing small amounts of DMT, you can get up to 20 years in prison and fines of up to $25,000.

The exceptions to this rule include two religious groups — União do Vegetal and Santo Daime — which have been granted access to the traditional DMT-containing plant brew called ayahuasca

What’s The Difference Between Legalization & Decriminalization

Many people believe that legalization and decriminalization mean the same thing, but there are some critical differences between these terms.

When the authorities decriminalize something, the penalties are considerably reduced — but the activity is still illegal. For example, if DMT was decriminalized, it would remove the felony charges associated with it. Instead, users would either be given a fine or simply have their contraband confiscated.

When authorities legalize something, all penalties are removed. At the same time, a new process for regulation is created in order to establish a legal market. There are often still regulations or restrictions around legalized substances — such as maximum order quantities and minimum age restrictions.

Key Takeaways: What’s The Future of Psychedelics in Wyoming?
